A district court judge, Anna Diggs Taylor just ruled that the warrantless wiretapping program used by the government is unconstitutional. In her 43 pages opinion, (which you can read here) she wrote that the warrantless violated both the first and the fourth Amendment. I agree with her opinion, but I know that this isn't the end of the matter . I am willing to bet that the Supreme Court is going to hear this case and that it will reverse this decision although it is possible that it won’t. Justice Kennedy, of course, will be the swing vote) and that congress, especially if it is still in the hands of the Republicans will do attempt to legislate this issue as much as it can. The best analysis of the Judge Taylor can be found here on Scotus Blog.
